Definitions

For purposes of this Privacy Policy:

• “AI Features” means functionality within the Birdview PSA application that uses artificial intelligence or machine learning to generate, summarize, or forecast, including the AI project plan assistant, the AI message assistant, and the project completion forecast.
• “AI Output” means the content, summaries, forecasts, or other results produced by AI Features.

Introduction & Scope

Introduction

Birdview PSA (“Birdview,” “we,” “us,” or “our”) is committed to protecting the privacy and personal information of individuals who interact with our website, software applications, and services. This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information, and outlines the rights and choices available to individuals regarding their personal information.

This Privacy Policy applies to personal information processed by Birdview in the course of operating our business, including through our website, the Birdview PSA application, marketing activities, sales processes, customer support, and other interactions.

Scope

This Privacy Policy applies to personal information collected or processed in connection �with:

Birdview‘s Role

• For personal information collected through our website, marketing activities, sales processes, and direct communications, Birdview acts as a data controller (or equivalent role under applicable law).
• For personal information processed within the Birdview PSA application on behalf of customers, Birdview acts as a data processor or service provider, processing such information solely in accordance with customer instructions, contractual obligations, and applicable data protection laws.

Customer control over AI Features. AI Features are used at the customer’s direction. Content is processed by an AI Feature only when a user of the customer’s account chooses to invoke that feature. By using AI Features, the customer represents that it is authorized to do so under its own policies, agreements, and legal obligations, and that any notices, consents, or approvals required in its jurisdiction – including in relation to employee data and works council consultation – have been obtained.

This Privacy Policy does not govern how Birdview customers collect, use, or disclose personal information within their own accounts. Customers are responsible for providing appropriate notices to their end users and complying with applicable privacy and data protection laws.

By accessing or using our website or the Birdview PSA application, you acknowledge that you have read and understood this Privacy Policy.

Information We Collect

Birdview collects personal information directly from individuals, automatically through the use of our website and application, and from customers or third parties in the course of providing our services. The categories of personal information we collect depend on how you interact with Birdview.

1. Information You Provide Directly

We may collect personal information that you voluntarily provide to us, including:

• Identifiers
  • Name
  • Business email address

  • Company name, job title, department
• Account and User Information
  • Username and authentication credentials
  • Role and permissions within the Birdview PSA application
  • User preferences and settings

Birdview may use AI-enabled tools, including services provided by OpenAI and Anthropic, to summarize, classify, and draft business communications with prospects, customers, and partners, and to support sales and marketing operations within our customer relationship management system. These tools assist Birdview personnel only, and outputs are reviewed by our team before use. Content processed by these tools is not used to train the providers’ models. This processing is separate from the AI Features in the Birdview PSA application and does not involve customer project data.

Meetings and calls. Where you participate in a video meeting or call with Birdview, we may record the session and generate a transcript, summary, notes, and action items using AI-enabled tools, including Zoom and Fathom. We also collect related meeting metadata such as date, time, participants, and meeting title.

We record only where all participants have been notified and, where required by applicable law, have consented. Notice is provided before recording begins. If you do not wish to be recorded, you may ask the meeting host to stop recording at any time, or decline to be recorded and continue the meeting without it. Withdrawing consent applies to recording from that point forward and does not affect the lawfulness of recording carried out beforehand.

We use recordings, transcripts, and derived notes to capture accurate records of our discussions, follow up on commitments, support internal training and quality assurance, and improve our services. Content processed by these tools is not used to train the providers’ AI models.

2. Information Collected Through Use of the Birdview PSA Application

When customers and authorized users access and use the Birdview PSA application, we may process the following categories of personal information on behalf of our customers:

• User Activity and Usage Data
  • Login history and timestamps
  • Actions taken within the application (e.g., creating or updating projects, tasks, assignments)
  • Audit logs and system activity records
• Work and Professional Information
  • Project-related information associated with users (e.g., assignments, schedules, workload, time entries)
  • Business contact information of users entered by customers into the platform
• Customer-Provided Content
  • Data uploaded or entered into the application by customers or users, including files, comments, notes, and structured project data
• AI Features
  • Where a customer uses AI Features, the content necessary to produce the requested AI Output, which may include project and task descriptions, message and comment text, and historical project timeline and effort data associated with individual users
  • The resulting AI Output, such as generated project plans, message summaries, and completion-date forecasts

Birdview processes this information as a data processor or service provider, solely to provide and support the Birdview PSA application, in accordance with customer instructions and applicable agreements.

3. Information Collected Automatically

We may automatically collect certain information when you visit our website or use the Birdview PSA application, including:

• Device and Technical Information
  • IP address
  • Browser type and version
  • Operating system
  • Device identifiers
• Usage and Interaction Data
  • Pages viewed and features used
  • Referring URLs
  • Date and time of access
  • Performance and error logs

This information is used to operate, secure, maintain, and improve our website and services.

How We Use Your Information

Birdview uses personal information only for legitimate, defined purposes and in accordance with applicable privacy and data protection laws. How we use personal information depends on the nature of the relationship and how individuals interact with our website and the Birdview PSA application.

1. To Provide and Operate the Birdview PSA Application

We use personal information to:

• Create, manage, and administer user accounts
• Authenticate users and manage access permissions
• Enable core application functionality, including project planning, resource management, time tracking, and reporting
• Process customer-provided content within the application
• Monitor system performance, availability, and security

When processing personal information within the Birdview PSA application, Birdview acts as a data processor or service provider on behalf of customers and uses the information solely to provide the services in accordance with customer instructions and contractual obligations.

AI Features. Birdview may use personal information to operate AI Features at the customer’s direction – to generate project plans and work breakdown structures, to draft, summarize, and improve written content within the application.

Large language model features. The AI project plan assistant and AI message assistant use the Azure OpenAI Service, operated by Microsoft within Birdview’s Microsoft Azure environment. Content submitted to these features:

• is not used to train or improve any AI model, whether Microsoft’s, OpenAI’s, or Birdview’s;
• is not accessible to OpenAI, and is not transmitted to ChatGPT or the OpenAI API;
• is not accessible to any other Birdview customer; and
• is not retained in the model, which is stateless.

AI Output may contain errors, omissions, or inaccuracies. AI Output is a suggestion for review by the customer’s users, not a determination. It should not be relied upon as the sole basis for decisions affecting individuals, including decisions about staffing, evaluation, compensation, or performance.

2. To Communicate With You

We use personal information to:

• Respond to inquiries, requests, and support tickets
• Provide customer support and technical assistance
• Send service-related communications, such as account notices, updates, and security alerts
• Communicate about onboarding, training, and product usage
  

3. For Sales, Marketing, and Business Development

Where permitted by law, we may use personal information to:

• Provide information about our products, services, events, and content
• Manage leads, prospects, and customer relationships
• Conduct marketing campaigns and measure their effectiveness

Opting out of marketing communications does not affect service-related communications necessary to provide the Birdview PSA application.

How We Share Your Information

Birdview does not sell personal information. We share personal information only as described below and only to the extent necessary to operate our business, provide the Birdview PSA application, and comply with legal obligations.

1. Service Providers and Subprocessors

We may share personal information with trusted third-party service providers and subprocessors that perform services on our behalf, such as:

• Cloud hosting and infrastructure providers
• Data storage and backup providers
• Customer support and ticketing systems
• Analytics and monitoring providers
• Email delivery and communications platforms
• Payment processing providers (for billing-related activities)

These service providers are authorized to process personal information only as necessary to provide services to Birdview and are contractually required to protect personal information and use it solely for specified purposes.

AI service providers. Birdview uses the Azure OpenAI Service, provided by Microsoft, to deliver certain AI Features. Content submitted to those features is processed within Birdview’s Microsoft Azure environment under the Microsoft Products and Services Data Protection Addendum, and is not used to train or improve any provider’s models.

A current list of Birdview’s subprocessors, including AI service providers, is available at https://birdviewpsa.com/company/sub-processor-list/. We update this list as our services evolve, and customers may request notice of changes by contacting [email protected].

2. Sharing in Connection With the Birdview PSA Application

For personal information processed within the Birdview PSA application, Birdview acts as a data processor or service provider on behalf of its customers.

• Personal information is shared only as directed by the customer.
• Customers control what personal information is uploaded, entered, or shared within their Birdview PSA environment.
• Customers may enable integrations with third-party applications, in which case personal information may be shared with those third parties at the customer‘s direction.

Birdview is not responsible for the privacy practices of third-party services enabled by customers.

3. Business Transfers

We may share personal information in connection with a corporate transaction, such as a merger, acquisition, reorganization, financing, or sale of all or a portion of our business or assets. In such cases, personal information will remain subject to appropriate confidentiality and security protections.

4. Legal and Regulatory Disclosures

We may disclose personal information where required to do so by law or where we believe disclosure is necessary to:

• Comply with applicable laws, regulations, or legal processes
• Respond to lawful requests from public or governmental authorities
• Protect the rights, property, or safety of Birdview, our customers, users, or others
• Enforce our agreements and policies

5. Aggregated or De-Identified Information

We may share aggregated or de-identified information that cannot reasonably be used to identify an individual for analytics, benchmarking, research, or business purposes.

6. No Sale or Sharing for Targeted Advertising

Birdview does not act as a data broker and does not sell, rent, license, or otherwise disclose personal information to third parties for their own independent commercial purposes.

Birdview does not share personal information for cross-context behavioral advertising, as those terms are defined under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA).

Birdview may disclose personal information to service providers and subprocessors for business purposes, including hosting, analytics, customer support, and security. Such disclosures are made pursuant to written agreements that prohibit the service provider from using personal information for purposes other than providing services to Birdview

Legal Bases for Processing (GDPR)

Where the General Data Protection Regulation (GDPR) applies, Birdview processes personal data on the following legal bases:

Where Birdview acts as a processor, AI Features are operated on the basis of contractual necessity and customer instruction. Where Birdview acts as a controller, AI-assisted processing of business communications is carried out on the basis of legitimate interests in responsiveness, record accuracy, and service improvement, balanced against the privacy expectations of the individuals concerned.

Birdview relies on consent as the legal basis for recording meetings and calls and for processing the resulting recordings, transcripts, and derived notes. Consent may be withdrawn at any time as described in the “Information We Collect” section. Where recording is not subject to a consent requirement, Birdview may rely on legitimate interests in record accuracy, internal training, and quality assurance.

Data Retention & International Data Transfers

Data Retention

Birdview retains personal information only for as long as necessary to fulfill the purposes for which it was collected, including to provide our services, comply with legal and contractual obligations, resolve disputes, and enforce our agreements.

Retention periods vary depending on the type of personal information and the context in which it is processed:

• Website, marketing, and sales information is retained for as long as reasonably necessary to manage relationships, respond to inquiries, and comply with applicable legal requirements.
• Customer account and application data processed within the Birdview PSA application is retained in accordance with customer instructions and applicable agreements. Customers control the retention and deletion of data within their environments.
• Support and communications data may be retained to maintain service continuity, improve support quality, and meet legal or compliance obligations.
• Technical and security logs are retained for a limited period to ensure system security, detect and investigate issues, and meet compliance requirements.

• Trial and prospect account data: retained for a limited period of up to 180 days after inactivity unless converted to a customer account.
• Customer application data: retained according to customer instructions and contractual agreements.
• Billing and financial records: retained as required by applicable accounting and tax laws.
• AI Output generated within the Birdview PSA application: stored as customer application data and retained and deleted under customer control.
• Content submitted to AI Features: not retained by the underlying model, which is stateless.

When personal information is no longer required, Birdview securely deletes, anonymizes, or de-identifies the information in accordance with its data retention policies and applicable law.

International Data Transfers

Birdview operates globally and may process and store personal information in jurisdictions other than the country in which an individual resides, including the United States, European Union and Canada, as well as other jurisdictions where Birdview or its service providers operate.

Data protection laws in these jurisdictions may differ from those in your country of residence. Where personal information is transferred outside of the European Union or European Economic Area (EU/EEA) or Canada, Birdview implements appropriate safeguards to ensure that personal information remains protected in accordance with applicable data protection laws.

These safeguards may include, as applicable:

• Standard Contractual Clauses (SCCs) approved by the European Commission
• Contractual data protection obligations with service providers and subprocessors
• Technical and organizational security measures designed to protect personal information

Birdview takes reasonable steps to ensure that international data transfers are lawful and adequately protected in accordance with applicable privacy and data protection laws.

AI Features. Content processed by AI Features is handled within Birdview’s Microsoft Azure environment, under the Microsoft Products and Services Data Protection Addendum and the transfer mechanisms it incorporates. Prompts and generated content are processed within the same Azure geography as the customer’s account. Accounts hosted in the European Union are processed in the European Union.

Your Privacy Rights

Depending on your location and applicable law, you may have certain rights regarding your personal information. These rights may differ based on whether Birdview acts as a data controller or a data processor on behalf of a customer.

Exercising Your Rights

To exercise your privacy rights, you may submit a request by contacting us using the details provided in the Contact Us section of this Privacy Policy. We may need to verify your identity before processing your request and will respond within the timeframes required by applicable law.

If your request relates to personal information processed within the Birdview PSA application on behalf of a customer, we may direct you to the relevant customer, as they control the data and are responsible for responding to such requests.

Rights of California Residents (CCPA/CPRA)

If you are a California resident, you have the following rights, subject to certain limitations:

For information stored within the Birdview PSA application, customers may correct or update personal information directly within their accounts, subject to applicable permissions and controls.

Withdrawal of Consent

Where Birdview relies on consent as the legal basis for processing personal information, you may withdraw your consent at any time. Withdrawal of consent will not affect the lawfulness of processing carried out before consent was withdrawn.

Please note that withdrawing consent may limit our ability to provide certain services or respond to requests, and in some cases, we may continue to process personal information where required or permitted by law.

While Birdview takes reasonable measures to protect personal information, no system or method of transmission over the internet is completely secure. Individuals should take care to protect their own credentials and devices when accessing the Birdview PSA application.

Children‘s Privacy

Birdview‘s website and the Birdview PSA application are not directed to children, and Birdview does not knowingly collect personal information from children under the age of 18.

If you are located in the European Union or European Economic Area, Birdview does not knowingly collect personal information from children under the age of 16, or such lower age as permitted by applicable law, without verifiable parental consent.

If your request concerns personal data processed by Birdview on behalf of your employer or another Birdview customer, please contact that organization first. As the data controller, it is responsible for responding to the request. Birdview will assist the customer with fulfilling verified requests as required by applicable law and our contractual obligations.
